Terms & Conditions
These Terms & Conditions ("Terms") apply to your use of promenadewines.com (the "Site") and to orders placed through it with Promenade Wine & Spirits ("Promenade", "we", "us"), a licensed New York retail liquor store. By using the Site, creating an account or placing an order you agree to these Terms and to our Privacy Policy and Delivery & Returns Policy.
1. You must be 21 or older
You must be at least 21 years old to create an account, place an order or receive a delivery. We do not sell alcohol to anyone under 21, and we do not sell alcohol to anyone for the purpose of giving it to a person under 21. Providing false age information is prohibited.
2. ID checks and our right to refuse service
A valid, unexpired, physical government-issued photo ID showing you are 21 or older must be shown at delivery or pickup. Digital or mobile IDs and photos or copies of an ID are not accepted, and the person receiving the order must be the person who placed it. We may refuse or cancel any order, or close any account, if ID is missing or appears altered, if the person receiving the order appears intoxicated, if we suspect an order is for someone under 21, or for any other lawful reason.
3. Your account
You are responsible for keeping your password confidential and for all activity under your account. Please tell us promptly if you suspect unauthorized use. You may delete your account at any time from My Account on the Site (see the Privacy Policy for what is kept).
4. Prices, availability and errors
Prices and availability can change without notice and may differ from in-store prices. We may limit quantities. If a product is listed at the wrong price or is unavailable, we may cancel or correct the order, and we will tell you before delivery.
5. Orders, payment, fees and taxes
Your total at checkout includes the item price, New York sales tax, a convenience fee, and any delivery fee for your ZIP code. An order is accepted when we confirm it. Payment options shown at checkout may change; some options, such as cash on delivery or Zelle, may be limited to eligible customers. You are responsible for any taxes or fees that apply to your purchase.
6. Out-of-stock items and pre-orders
Items that are out of stock may be pre-ordered by the full case. Pre-orders are scheduled for delivery on or after the date shown at checkout, which is generally about one week out, and that date is an estimate that depends on our supplier.
7. Cancellations and returns
Our Delivery & Returns Policy explains how to cancel an order and when we will replace or refund an item.
8. Rewards program
Promenade Rewards points are earned on eligible purchases and may be redeemed as described on the Site. Points have no cash value, cannot be transferred, and may be adjusted if an order is cancelled or returned. We may change, suspend or end the program or any promotion at any time.
9. Acceptable use
You agree not to: use the Site for any unlawful purpose; use another person's identity or ID; interfere with or overload the Site; scrape, copy or resell our product data, images or content; or attempt to gain unauthorized access to any account or system.
10. Intellectual property
The Site's content, design, logos and images belong to Promenade or its licensors and may not be reused without permission. Brand names and product images belong to their respective owners.
11. Disclaimers and limits of liability
The Site is provided "as is" and "as available". To the fullest extent permitted by law, Promenade is not liable for indirect, incidental or consequential damages arising from use of the Site or from orders, and our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited under New York law. Please drink responsibly; alcohol should not be consumed by pregnant women, before driving or operating machinery, or by anyone with a health condition affected by alcohol.
12. Governing law
These Terms are governed by the laws of the State of New York, and disputes will be heard in the state or federal courts located in Queens County or the Eastern District of New York, except where the law requires otherwise.
13. Changes to these Terms
We may update these Terms from time to time. The "last updated" date above shows the current version. Continued use of the Site after a change means you accept the updated Terms.
14. Accessibility
